  1. Overview

GigWerk (“GigWerk,” “we,” “us,” or “our”) operates an online marketplace that connects independent performers (“Talent”) with venues, promoters, and event organizers (“Venues”). GigWerk is not a talent agency, employer, or booking agent. We do not set rates, guarantee work, or control performance outcomes.

By accessing or using GigWerk, you agree to these Terms of Service (“Terms”).

  1. Eligibility

You must be at least 18 years old and legally able to enter contracts to use GigWerk. By creating an account, you represent that all information you provide is accurate and complete.

  1. Marketplace Role & No Agency Relationship

GigWerk acts solely as a technology platform:

• Talent are independent contractors.

• Venues contract directly with Talent.

• GigWerk does not supervise, direct, or control performances.

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.

  1. Accounts & Listings

• Talent are responsible for the accuracy of their listings, rates, availability, and descriptions.

• Venues are responsible for providing accurate event details.

• GigWerk reserves the right to remove listings or suspend accounts that violate these Terms.

  1. Bookings & Payments

• Venues pay upfront through GigWerk’s payment processor.

• Funds are held until the booking is completed according to GigWerk’s transaction rules.

• GigWerk deducts its platform fee before releasing payouts to Talent.

• Talent must complete payment onboarding to receive payouts.

GigWerk does not handle cash payments, checks, or off-platform transactions.

  1. Cancellations & Refunds

Cancellation and refund terms are determined by:

• The booking type

• Timing of cancellation

• Platform rules in effect at the time of booking

GigWerk may issue refunds or withhold payouts when required by platform rules, payment processor requirements, or disputes.

  1. Conduct & Content

Users agree not to:

• Misrepresent themselves or others

• Engage in harassment, discrimination, or illegal activity

• Circumvent platform fees or payments

• Upload content that is unlawful, explicit (unless permitted by law and venue), or infringing

GigWerk may suspend or terminate accounts at its discretion.

  1. Disputes Between Users

GigWerk is not responsible for disputes between Talent and Venues. Users agree to resolve disputes directly. GigWerk may assist at its discretion but is not obligated to intervene.

  1. Limitation of Liability

To the maximum extent permitted by law, GigWerk is not liable for:

• Lost income or bookings

• Performance outcomes

• Venue conditions

• Personal injury or property damage

• Acts or omissions of users

Use of GigWerk is at your own risk.

  1. Indemnification

You agree to indemnify and hold GigWerk harmless from any claims arising from:

• Your use of the platform

• Your performances or events

• Violations of these Terms

  1. Termination

GigWerk may suspend or terminate access at any time for violations of these Terms or to protect platform integrity.

  1. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
